Terms of Service

1. Who you are dealing with
Emberfeed is operated by Daniel Šilha, sole trader registered in the Czech Trade Licensing Register (živnostenský rejstřík), IČO 05377595, Letenské náměstí 76/3, 170 00 Prague 7, Czech Republic ("we", "us"). Contact: [email protected]. By creating an account or using emberfeed.com you agree to these terms.
2. What Emberfeed does
Emberfeed imports your product feed, lets you design image templates, and serves a new feed URL in which every product image is rendered with your design. It is a tool for businesses running product catalogs; by creating an account you confirm that you are acting within your trade, business or profession, not as a consumer. Emberfeed is an independent tool and is not affiliated with, endorsed by, or sponsored by Meta, Google, TikTok, Heureka or any other ad platform; their names are used only to describe compatibility.
3. Free trial and free tier
- New accounts get a free trial with the parameters shown at signup — at the moment 90 days, 1 feed and up to 1,000 products after filtering. The parameters in force when you sign up apply for the whole of your trial; we may change them for future signups.
- When the trial ends (or a free feed exceeds the product limit), the served feed stops delivering product data and returns a notice instead, until you upgrade. Your data, templates and settings stay saved.
- Where you have an active feed, we e-mail you before your trial expires; you can opt out of those e-mails.
- The free trial is available once per customer; we may decline or close duplicate accounts created to obtain repeated trials.
4. Paid plan and billing
- The paid plan costs 25 EUR per month per feed (unlimited products, all features). Activation is currently manual: you request an upgrade, we invoice you and switch the feed to paid. "Unlimited products" means unrestricted use for a normal single-shop catalog; for exceptional volumes (as a guide, feeds over 100,000 products) or automated request patterns far beyond ad-platform crawling, we may ask you to agree a custom plan — we will always contact you first rather than degrade the service silently.
- Fees are payable in advance for the agreed period and are non-refundable for periods already started, except where required by law, or where the service was materially unavailable and we failed to restore it within a reasonable time after you notified us — in which case we refund the affected period pro rata.
- Invoices are due within 14 days. If an invoice remains unpaid 14 days after the due date, we may — after a reminder — suspend serving the affected feed until payment; your data and templates stay saved. Statutory late-payment interest may apply.
- If a paid period ends and is not renewed, the feed returns to the free-tier limits and may stop serving product data (as described in Section 3) until payment is received.
- We may change prices with at least 30 days' notice; changes apply from your next billing period.
5. Your content and your responsibilities
- Your feed data, product images, logos, fonts and other assets remain yours. You grant us a licence to store, process and transform them solely to provide the service (rendering and serving your catalog images).
- You confirm you have the rights to the content you import or upload, and that your use complies with the ad platforms' own policies.
- You must not use Emberfeed for unlawful content, attempt to breach or probe its security, resell access without our consent, or knowingly overload the service beyond normal catalog use.
- You are responsible for keeping your account credentials safe.
6. Our software
The Emberfeed software, site, design and rendering engine are ours (or our licensors'). These terms give you a right to use the service, not a licence to the software itself.
7. Availability and support
We run Emberfeed with care — cached rendering, monitoring and daily backups — but it is provided without a guaranteed uptime level (no SLA). Short maintenance windows and occasional interruptions can happen. Support is provided by e-mail on a best-effort basis; response-time indications are not a contractual commitment. Neither party is liable for failure caused by events beyond its reasonable control (e.g. outages of hosting or network providers, natural disasters, government action); obligations are suspended for the duration of such an event.
8. Data protection
How we handle personal data is described in our Privacy Policy. Where your feed content contains personal data, our Data Processing Agreement forms part of these terms automatically. The DPA is available at emberfeed.com/dpa at all times and you confirm you had the opportunity to review it before accepting these terms.
9. Liability
- The service is provided "as is". To the extent permitted by law, we are not liable for indirect or consequential loss — including lost profits, lost ad spend, or decisions made by third-party ad platforms (e.g. catalog rejections or account actions).
- To the extent permitted by law, our total liability for all claims in any 12-month period — including claims under the Data Processing Agreement, except where the GDPR or Czech law does not permit limitation — is capped at the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim and (b) 100 EUR.
- Nothing in these terms excludes or limits liability for harm caused intentionally or by gross negligence, for harm to a person's natural rights (including life and health), or any other liability that cannot be excluded or limited under Czech law.
10. Term and termination
- You can stop using Emberfeed at any time. If you ask us to delete your account, we delete your data within 30 days (backup snapshots cycle out automatically within a further 7 days). On request before deletion, we will provide an export of your templates, uploaded assets and stored feed data.
- When your account ends, the served feed URLs stop returning product data — you are responsible for repointing your ad-platform catalogs to another source.
- We may suspend or terminate accounts that materially breach these terms; where practical we will warn you first and give you a chance to fix the issue.
- If we ever discontinue the service, we will give paying customers at least 60 days' notice and refund any prepaid unused period.
11. Changes to these terms
We may update these terms to a reasonable extent — for example to reflect changes in the service, the law or security practice; changes will not retroactively alter fees already agreed (price changes follow Section 4). For material changes we will notify registered users by e-mail at least 14 days in advance; continuing to use the service after the effective date means you accept the new terms. If you do not, you can terminate before they take effect — and if you terminate because you reject a material change, we will refund any prepaid unused period pro rata.
12. Governing law
These terms are governed by Czech law. Disputes are subject to the exclusive jurisdiction of the Czech court having local jurisdiction for our registered office in Prague. If you use the service as a consumer, mandatory consumer protections — including jurisdiction rules — of your country of residence are unaffected.
13. Final provisions
- Notices to you are sent to your account e-mail address and count as received when sent; please keep it current. Notices to us go to [email protected].
- We may assign these terms and your contract to a legal successor of the Emberfeed business (for example a company we form or an acquirer); we will notify you of any such transfer. You may not assign your account without our consent.
- If any provision of these terms is invalid, the remainder stays in force.
- Sections 5, 6, 9 and 12 survive termination.
- If you send us suggestions or feedback, we may use them without obligation to you.
